Terms of Service
Effective Date: February 13, 20261. Introduction
Welcome to RealLink AI ("we," "our," or "us"). By accessing or using our website, services, and AI chatbot platform (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Service Description & Regulatory Role
RealLink AI provides a SaaS platform that allows users ("Business Users") to create, train, and deploy AI chatbots. We utilize third-party services, including Google Gemini and Cloudflare.
Regulatory Role Definition (EU AI Act & Global Standards):
1. RealLink AI (Provider): We provide the technical infrastructure and foundational AI tools.
2. Business User (Deployer): You are the "Deployer" who configures, trains, and offers the chatbot to End Users. You are solely responsible for determining if your specific use case is classified as "High-Risk" under EU AI Act Annex III or other local regulations.
We reserve the right to modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice. You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuance.
3. Account Registration
To create an account, purchase a subscription, manage billing, or upload training data, you must be at least 18 years old and legally capable of entering a binding agreement on behalf of yourself or your business. Before completing a paid checkout, we may require you to expressly confirm that you are at least 18 and legally able to enter this agreement, and we may require renewed confirmation if we update that eligibility notice or checkout flow. You are responsible for maintaining the confidentiality of your account and for ensuring that any use of the Service under your account is permitted by applicable law.
4. Subscription, Billing, and Cancellation
4.1. Immediate Access & Waiver of Withdrawal Right
By subscribing to a paid plan, you expressly agree that the Service begins immediately upon payment. You acknowledge and agree that you lose your right of withdrawal (cooling-off period) once the digital content or service has started.
4.2. Billing Cycle & Auto-Renewal
The Service is billed on a monthly subscription basis. You will be billed in advance on a recurring basis. Your subscription automatically renews unless canceled at least 24 hours before the end of the current period.
4.3. Refund Policy
Except where required by law or expressly stated below, fees are non-refundable. Because RealLink AI provides immediate access to digital services and reserves or consumes server and API resources upon activation or use, we do not provide refunds for partial subscription periods, unused time, plan changes, taxes, promotional credits, or rolled-over benefits.
Disputes and Chargebacks: In the event of a payment dispute or chargeback, RealLink AI reserves the right to use your system usage logs, IP address, and transaction history as evidence to validate the legitimacy of the charge. Fraudulent or abusive chargebacks may result in immediate suspension or permanent account termination.
4.3.A. Limited Refund Exception (Eligibility Review)
We may offer a limited dashboard refund option only for a recent qualifying payment and only if all eligibility conditions are met, including: (i) the request is submitted within 7 calendar days, (ii) AI usage remains 0 for the relevant subscription cycle, (iii) the subscription is still active, and (iv) the account and payment pass our fraud, abuse, and payment-integrity checks. Once any AI usage begins, or if a plan change, tax amount, prior credits, abuse signal, dispute, or other ineligible condition is involved, the payment becomes non-refundable to the maximum extent permitted by law. Approved refund requests may deactivate the chatbot immediately and can take 5-10 business days to appear on the original payment method.
4.4. Plan Changes (Upgrades & Downgrades)
If you change your plan (either Upgrade or Downgrade) during an active billing cycle, the following rules apply immediately:

- Immediate Payment: You will be charged the FULL price of the new plan immediately upon change. This action starts a new subscription contract.
- Capacity Stacking (Rollover Benefit): Any remaining capacity/credits from your previous plan will be added (stacked) to your new plan's capacity for the first month. (e.g., Remaining Old Credits + New Plan Credits = Total Available).
- Cycle Reset: Your billing cycle resets to the date of the plan change. The new renewal date will be one month from today.
4.5. Cancellation
You may cancel your subscription at any time through your dashboard. Cancellation turns off auto-renewal for the next cycle. You will continue to have access until the end of your current paid period.
4.6. Taxes and Fees
You are responsible for all applicable taxes, and we will charge tax when required to do so.
4.7. Provisional Access & Unpaid Usage (Anti-Abuse Policy)
To provide a seamless experience, we may grant immediate access to upgraded features upon the initiation of a checkout process ("Provisional Access"). However, if your underlying payment ultimately fails, is declined, or remains unpaid after the processor's retry attempts:
1. We reserve the right to immediately suspend your chatbot or revert your account to its previous state without prior notice.
2. We reserve the right to bill you for any AI capacity (messages/tokens) consumed during the Provisional Access period.
3. Intentional exploitation of Provisional Access using empty, prepaid, or invalid payment methods is a material breach of these Terms and will result in a permanent ban from RealLink AI.
4. If a delayed payment is successfully processed after a significant period (e.g., beyond 6 days), it may be treated as a new billing cycle, and any rollover benefits from the previous plan may be forfeited.
5. Responsibilities of Business Users (Deployers)
As a Business User deploying chatbots to your own customers ("End Users"), you explicitly agree to the following. These rules form part of our Acceptable Use Policy and are material conditions of access to the Service.
- Public & Cleared Data ONLY (No Confidential Data): You acknowledge that any data, documents, or text you upload to train your chatbot will be actively used by the AI and may be revealed to your End Users during chats. You strictly agree NOT to upload any trade secrets, confidential business information, unreleased product details, or Sensitive Personal Information (e.g., SSNs, medical records, unmasked financial data). RealLink AI acts solely as a data processor and bears zero liability for any data exposure, business loss, or privacy breach resulting from the training materials you choose to upload.
- End User Consent: You are solely responsible for obtaining all necessary consents regarding data collection and AI usage.
- Compliance: You must ensure your deployment complies with GDPR, CCPA, PIPA, and other laws.
- Restricted Uses: You must not configure, market, or deploy the Service primarily for minors under 16 or as a service for individualized medical, legal, financial, or mental-health advice or guidance.
- Adult Sexual Content & Services Prohibited: You must not use the Service to create, train, operate, promote, distribute, or facilitate pornography, sexually explicit adult content, nudity intended for sexual gratification, escort or prostitution-related services, fetish or sexual services, adult live-chat or cam services, or any chatbot, popup, link, redirect, or destination primarily designed for such content or services.
- Permitted General Business Use: These restrictions do not prevent ordinary customer-service, business-information, or marketing use. You may use the Service to share business hours, reservation availability, pricing, menus, service descriptions, location, parking, contact methods, brand or store introductions, general FAQs, promotions, discounts, coupons, event information, seasonal campaigns, gift card information, loyalty offers, and brand or store news and updates. This also applies to regulated industries when the chatbot is used only for general business information and not for individualized professional advice.
- No Direct Collection in Chat: You must not use the chat interface to request or collect names, phone numbers, email addresses, or reservation details directly. If you offer booking or contact options, you may direct users to an external booking or contact link managed separately.
- Why Contact & Booking Details Stay Outside Chat: This rule is intended to reduce privacy and compliance risk inside the chat interface, not to block bookings, inquiries, or sales. You may still use the chatbot to answer questions, highlight offers, encourage reservations, and send users to a separate booking, inquiry, or checkout flow managed through an external link.
- External Links & Third-Party Destinations: You are solely responsible for every URL, domain, landing page, booking page, payment page, messaging link, popup link, redirect, or other third-party destination that you register, upload, embed, include in training materials, or cause the Service to display. You represent and warrant that each such destination is lawful, accurate, non-deceptive, reasonably safe, and operated by you or used with full authorization.
- Prohibited Link Practices: You must not use the Service to display, promote, or route users to links or destinations that are misleading, impersonating, phishing-like, malicious, malware-distributing, credential-harvesting, unauthorized-redirecting, disguised through deceptive formatting, or otherwise unlawful, harmful, or abusive.
- Safety Screening, Warnings & Blocking: RealLink AI may scan, classify, warn, delay, block, disable, remove, or refuse to open any link or destination where we detect or reasonably suspect policy, safety, fraud, legal, platform, payment, reputational, or security risk. We may also change how such links are presented to End Users, including adding warnings or requiring extra confirmation before opening. You agree that we are not liable for any traffic loss, conversion loss, business interruption, or other damages arising from these safety measures.
- Fair Use & API Limits: We reserve the right to throttle usage that threatens system stability.
- Anti-Circumvention: You agree NOT to attempt to bypass, override, or "jailbreak" safety filters via prompt injection.
6. Protection of Minors & Vulnerable Users
To comply with child-safety, privacy, and platform-safety requirements in the US, EU, and other jurisdictions, the following rules apply:
- Account-Level Age Rule: Business User accounts, billing, subscription management, and training-data uploads are intended only for adults aged 18 or older.
- Public Chat Access: Public chatbot interfaces are intended only for individuals aged 16 or older. You must not configure or operate a public chatbot experience for persons under 16 through this Service.
- Children Under 13: You must not knowingly deploy or market this Service to children under 13, and you must not knowingly collect children's personal data through the Service except where lawful and independently managed by you with any required notices and verified consent.
- Prohibited Targets: You strictly agree NOT to deploy chatbots targeting minors under 16 or to use the Service as medical, legal, financial, or mental-health advice for End Users.
- Zero Tolerance for Sexual Content Involving Minors: Any sexual content, grooming, exploitation, or sexualized interaction involving minors is strictly prohibited and will result in immediate suspension or termination, reporting where appropriate, and removal of related content.
- Crisis Protocol: If your chatbot detects keywords related to self-harm, suicide, or violence, you must configure it to immediately provide helpline numbers (e.g., 988 in US, 1393 in KR).
- Immediate Termination: RealLink AI reserves the right to immediately terminate accounts that endanger minors or vulnerable populations.
7. Intellectual Property Rights
- Our IP: RealLink AI owns the Service platform and code.
- Your IP: You retain ownership of your uploaded files. You grant us a license to process them for the Service.
- Output Ownership: We assign rights in the AI output to you, subject to compliance with these Terms.
8. AI Transparency, Accuracy & Hallucinations
To comply with regulations (EU AI Act, Air Canada Case Precedents), adhere to the following:
- No Guarantee of Accuracy (Hallucinations): AI (LLMs) can produce factually incorrect or fabricated information ("hallucinations"). RealLink AI does not guarantee the accuracy of any output.
- Mandatory Human Review (Tier 1): For critical use cases (medical, legal, financial, safety), you MUST implement a human review process before End Users act on AI advice.
- Transparency (Watermarking): You must disclose to End Users that they are interacting with an AI. Do not remove or obscure the "AI-Generated" watermark.
- Mandatory Revocation: We reserve the right to terminate access within 96 hours if we detect intentional removal of transparency markers (California SB 942 compliance).
9. Disclaimer of Warranties & Limitation of Liability
9.1. "AS IS" Basis: The Service is provided "AS IS". We explicitly disclaim warranties of merchantability or fitness for a particular purpose.
9.2. Limitation of Liability: To the maximum extent permitted by law, RealLink AI shall not be liable for indirect damages. We are not responsible for any third-party site, product, service, redirect, payment page, booking page, or other destination linked, uploaded, embedded, trained on, or displayed by a Business User, nor for any loss arising from warning, blocking, disabling, removal, or suspension of suspicious links, destinations, chatbots, or accounts. However, regarding users in Japan, this limitation does not apply in cases of our intentional misconduct or gross negligence.
9.3. Indemnification: You agree to indemnify, defend, and hold harmless RealLink AI, its officers, and affiliates from any claims, damages, losses, liabilities, penalties, investigations, or legal actions arising out of: (a) your End Users' use of the Service; (b) your violation of these Terms; (c) failure to protect minors or comply with transparency laws; (d) any unauthorized exposure, leak, or breach of confidential information, trade secrets, or personal data that you voluntarily uploaded to the Service as AI training material; (e) any adult sexual content, explicit material, or sexual service that you upload, train, display, promote, or cause the Service to surface; or (f) any URL, link, domain, destination, redirect, popup, booking page, payment page, or third-party site that you register, upload, embed, include in training materials, or cause the Service to display, including any claim that such destination was unlawful, misleading, infringing, unsafe, malicious, or harmful.
10. Termination
We may terminate, suspend, pause, restrict, unpublish, block, cancel, or investigate your account, subscription, chatbot, content, training data, or external links immediately and without prior notice if you breach these Terms or if we detect or reasonably suspect fraud, phishing, malware, impersonation, abuse, deceptive practices, unlawful conduct, policy violations, user harm, payment risk, reputational risk, security risk, or prohibited adult sexual content or services. Specifically, violation of our Payment Processor's (Creem) or Cloud Provider's (Google) Acceptable Use Policy will result in immediate suspension. Adult sexual content violations may be actioned immediately, including blocking, unpublishing, or removing related links, chatbots, destinations, or training materials, to the extent permitted by applicable law. In urgent or risk-related cases, we may take action first and review later, and you agree that you are not entitled to continued service, publication, prior warning, compensation, damages, or refunds except where required by applicable law.
11. Dispute Resolution & Governing Law
11.1. Class Action Waiver: You agree to resolve disputes only on an individual basis and waive any right to bring a class action lawsuit.
11.2. Governing Law: These Terms shall be governed by the laws of Republic of Korea.
